Refund Policy

This Refund Policy explains how refunds, cancellations, and credits are handled for services and deliverables provided by Skillnest ("Company," "we," "us," or "our"), located at 433 Park Point Dr, Golden, CO 80401. This policy is intended to be read together with our Terms of Service and any applicable proposal, Statement of Work ("SOW"), or project contract. If there is a conflict, the signed SOW/contract controls for that engagement.

1. Scope of This Policy

Skillnest primarily provides custom professional services (learning design, development, interactive modules, simulations, UX audits, LMS integration, consulting). Because these services involve time-based work and custom deliverables, refunds are handled differently than off‑the‑shelf products.

2. Deposits, Upfront Fees, and Discovery

  • Discovery / strategy / kickoff fees (including workshops, audits, and paid discovery) are generally non-refundable once the work has started, because time and expertise are immediately allocated.
  • Deposits may be non-refundable if specified in the SOW. If not specified, deposits are refundable only to the extent Skillnest has not begun work or incurred non-recoverable costs.

3. Milestone-Based Work and Partial Refunds

Most engagements are billed by milestones. If you cancel a project mid‑engagement:

  • You are responsible for payment for all work completed up to the cancellation effective date, including any in-progress work reasonably performed.
  • Fees tied to completed and approved milestones are non-refundable.
  • If you have pre-paid for a future milestone that has not started, we will refund the unused portion minus any non-recoverable costs (e.g., licensed assets purchased specifically for your project), if applicable.

4. Custom Digital Deliverables (Modules, Simulations, UX Designs)

Custom deliverables created specifically for your organization (e.g., micro-modules, scenario simulations, interactive assessments, mobile-first redesigns, learning paths) are generally not eligible for a “return” once delivered, because they are bespoke work products. If an issue arises, our standard remedy is to correct defects or rework items that do not match the agreed scope/acceptance criteria in the SOW.

5. Non-Refundable Items

  • Completed professional services time (design, development, consulting) already performed.
  • Third‑party costs and pass‑through expenses (e.g., stock assets, software licenses, translation services) that were purchased or committed on your behalf.
  • Work delivered in accordance with the SOW and accepted (or deemed accepted per the review timeline in the SOW).

6. If Skillnest Cannot Deliver

If Skillnest is unable to materially deliver the services as described in the signed SOW for reasons within Skillnest’s control, you may be eligible for a refund of fees paid for the undelivered portion of the services. Any refund determination will consider work already completed and any deliverables already provided.

7. How to Request a Refund or Cancellation

To request a refund review or to cancel an engagement, contact us in writing with:

  • Your company name and primary contact
  • Project/SOW name (or invoice number)
  • Reason for the request
  • Any supporting details (dates, milestones, communications)

8. Refund Processing Time

If a refund is approved, we will process it to the original payment method when possible. Processing times vary by payment provider, but typically take 5–10 business days after approval.

9. Chargebacks

We encourage clients to contact us first to resolve billing questions. Initiating a chargeback without first attempting good-faith resolution may delay the project and may result in suspension of services while the dispute is investigated.

10. Changes to This Refund Policy

We may update this Refund Policy from time to time. The “Last Updated” date above reflects the most recent revision. Continued use of our services after changes become effective constitutes acceptance of the updated policy.
